These Terms and Conditions apply to all contracts concluded between

The following terms (hereinafter "Provider," "we," or "us") and our customers (hereinafter "Customer" or "you") apply exclusively to purchases made via our online store. By placing an order, you agree to be bound by these terms.

§ 1 Scope and Definitions

(1) These Terms and Conditions apply to all business transactions between the Provider and the Customer in the version valid at the time of the order. Any deviating terms provided by the Customer are hereby rejected.
(2) A "Consumer" is any natural person placing an order for purposes that are predominantly not related to their commercial or self-employed professional activity. An "Entrepreneur" is a natural or legal person acting in the exercise of their commercial or professional activity.

§ 2 Contract Formation

(1) You may select products from our range and collect them in a "shopping cart." By clicking the "Complete Purchase" (or similar) button, you submit a binding offer to purchase the goods in your cart.
(2) The contract is formed only when we issue a declaration of acceptance, which is sent via a separate email (Order Confirmation or Invoice), or by the delivery of the goods. An automated confirmation of receipt does not constitute acceptance of your offer.
(3) Promotional Items: We may occasionally include free promotional items with your order. These are subject to availability, excluded from exchange, and do not carry a right to subsequent delivery if missing or damaged.

§ 3 Availability and Delivery

(1) If the product you ordered is temporarily unavailable, we will inform you immediately. In the event of permanent unavailability, we reserve the right to withdraw from the contract and will refund any payments already made.
(2) Delivery times stated on the product page apply. If no time is specified, the standard delivery time is approximately 7-14 business days for international shipments.

§ 4 Retention of Title

The delivered goods remain the property of the Provider until full payment of the purchase price has been received.

§ 5 Prices and Shipping

(1) All prices include applicable statutory taxes. Shipping costs are calculated and displayed during the checkout process.
(2) Import Duties: For deliveries outside the EU (including the US), additional customs duties, taxes, or fees may apply. These are the sole responsibility of the Customer and are payable to the local customs or tax authorities, not to the Provider.

§ 6 Payment Terms

(1) Payment must be made using the methods provided in the online store.
(2) Payment of the purchase price is due immediately upon conclusion of the contract. If payment is not received within 7 days, we reserve the right to cancel the order.

§ 7 Shipping and Risk of Loss

(1) For Consumers, the risk of accidental loss or damage to the goods passes to the Customer upon delivery of the goods.
(2) For Entrepreneurs, the risk of loss passes to the Customer as soon as we deliver the goods to the carrier or shipping service provider.

§ 8 Warranty and Liability

(1) We provide a warranty for defects in accordance with statutory regulations.
(2) Disclaimer: To the extent permitted by law, we are not liable for damages resulting from improper use, independent repair attempts, or modifications made by the Customer.
(3) We are only liable for damages caused by intent or gross negligence. For slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.

§ 9 Return Policy

Consumers generally have a right to return goods within 14 days. Detailed information, including the conditions for our "KUDDE® 100-Night Sleep Trial," can be found in our Return Policy. Custom-made or personalized products are excluded from returns.

§ 10 Final Provisions

(1) These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For Consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
